1. Introduction and Acceptance
Welcome to CameKart (“Platform”), an online photography equipment marketplace operated at camekart.com. These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and CameKart (“we”, “us”, “our”).
By registering an account, accessing, or using any part of the CameKart platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our platform.
2. Eligibility
To use CameKart, you must:
- Be at least 18 years of age
- Be a resident of India or conduct photography/videography business in India
- Provide accurate and complete information during registration
- Not be barred from using online services under applicable Indian law
By registering, you represent and warrant that you meet all of the above requirements.
3. Account Registration and Security
3.1 Account Creation
You must register with a valid email address and mobile number. You are responsible for maintaining the confidentiality of your login credentials.
3.2 Account Accuracy
You agree to provide truthful, accurate, and up-to-date information on your profile. Providing false information — including fake equipment listings, fabricated experience, or misleading contact details — is a violation of these Terms and may result in account suspension.
3.3 Account Security
You are solely responsible for all activity that occurs under your account. If you suspect unauthorized access to your account, notify us immediately at support@camekart.com.
3.4 One Account Per User
Each user may maintain only one active account. Creating multiple accounts to circumvent platform rules or earn duplicate welcome bonuses is strictly prohibited.
4. Platform Usage Rules
4.1 Permitted Use
CameKart is intended solely for:
- Photographers and videographers to create and display professional profiles
- Equipment providers to list cameras, lenses, drones, gimbals, and related gear for rent
- Clients to search for photographers and equipment, send interest requests, and view contact information
4.2 Prohibited Conduct
You agree NOT to:
- Post false, misleading, or fraudulent listings or profile information
- Enter mobile numbers, WhatsApp numbers, or any contact information in text fields such as bio, description, item names, or terms — these are detected and blocked by the platform
- Spam other users with unsolicited messages or interest requests
- Use the platform to harass, threaten, or harm other users
- Attempt to bypass the points system to obtain contact information without proper payment
- Use automated bots, scrapers, or crawlers on the platform
- Reverse engineer, modify, or tamper with any part of the platform
- Upload content that is obscene, defamatory, or violates any third-party rights
- Use the platform for any purpose other than legitimate photography and equipment services
- Create fake reviews or ratings for your own or others’ profiles
4.3 Contact Information in Fields
To maintain fairness and prevent spam, the platform automatically blocks mobile numbers from being entered in profile text fields. Contact details are shared only through the official interest and contact unlock system.
5. Profile and Listings
5.1 Profile Responsibility
You are solely responsible for the accuracy and legality of information on your CameKart profile, including equipment details, availability, pricing, work types, and location.
5.2 Equipment Listings
All equipment listed for rent must:
- Be genuinely owned or authorized for subletting by the listing user
- Be accurately described with correct specifications
- Be available on the dates marked in your availability calendar
5.3 Profile Visibility
Your public profile — including your name, location, equipment list, work types, and availability — is visible to all registered users of CameKart. Contact details (mobile number) are visible only after the other party spends points or after an interest request is accepted.
5.4 Content Ownership
By uploading photos, descriptions, and other content to CameKart, you grant us a non-exclusive, royalty-free license to display your content on the platform for the purpose of operating the service. You retain full ownership of your content.
6. Points and Wallet System
6.1 Welcome Bonus
New users receive 100 welcome points upon successful account registration. This bonus is granted once per user and is non-transferable.
6.2 Earning and Using Points
Points can be earned through platform activities and used to unlock contact details of other users. The current cost to unlock a contact is 10 points.
6.3 Recharge
Points can be purchased through the Points & Recharge section. All point purchases are final and non-refundable.
6.4 No Cash Value
Points have no monetary value and cannot be converted to cash, transferred to another user, or withdrawn from the platform.
6.5 Expiry
Points do not expire as long as your account remains active. CameKart reserves the right to expire points with prior notice of at least 30 days.
7. Interest and Lead System
7.1 Sending Interest
Registered users may send interest requests to photographers or equipment providers. Each request must include genuine contact information and intended use.
7.2 Acceptance and Rejection
Photographers may accept or reject received interest requests at their discretion. CameKart does not guarantee any specific outcome from interest requests.
7.3 Auto-Rejection
Interest requests that remain unresponded for 72 hours are automatically marked as expired.
7.4 Contact Sharing
Upon acceptance of an interest request, both parties’ contact details are shared with each other. This shared information must be used only for legitimate booking and professional purposes.
7.5 No Guarantee of Booking
CameKart facilitates introductions between users. We do not guarantee that any interest request will result in a confirmed booking, successful shoot, or satisfactory service.
8. Ratings and Reviews
- Ratings can only be submitted by registered users who have genuine experience with a photographer
- False, malicious, or paid reviews are strictly prohibited
- CameKart reserves the right to remove ratings that violate these Terms without prior notice
- Attempting to manipulate your own rating through fake accounts will result in permanent account suspension
9. Payments and Transactions
CameKart currently facilitates point purchases for contact unlocking. All payments are processed securely. CameKart does not handle payments between photographers and clients — those transactions occur directly between the parties and are outside the scope of CameKart’s responsibility.
CameKart is not liable for:
- Disputes between photographers and clients regarding payment for shoots
- Equipment damage during rentals arranged through the platform
- Non-delivery of services agreed between users
10. Cancellation and Refund Policy
10.1 Point Purchases
All point purchases are final. We do not offer refunds on purchased points except in cases of proven technical error where points were deducted but not credited.
10.2 Account Deletion
You may delete your account at any time. Upon deletion, your remaining point balance is forfeited with no refund.
10.3 Disputed Transactions
If you believe a point deduction occurred in error, contact us within 7 days of the transaction at support@camekart.com with details of the issue.
11. Intellectual Property
All content on CameKart that is not uploaded by users — including the logo, design, interface, code, graphics, and text — is the exclusive intellectual property of CameKart and is protected under applicable Indian copyright and trademark laws.
You may not copy, reproduce, distribute, or create derivative works from CameKart’s proprietary content without prior written permission.
12. Disclaimers and Limitation of Liability
12.1 Platform Provided “As Is”
CameKart is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.
12.2 No Endorsement
Listing on CameKart does not constitute endorsement of any photographer, videographer, or equipment provider by CameKart. Users must conduct their own due diligence before entering into agreements.
12.3 Limitation of Liability
To the maximum extent permitted by applicable law, CameKart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Use or inability to use the platform
- Disputes between users
- Equipment damage or loss during rentals
- Failure of a booked photographer to deliver services
- Unauthorized access to your account
Our total liability in any circumstance shall not exceed the amount of points purchased by you in the 3 months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless CameKart, its owners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any third-party rights
- Any dispute between you and another user
14. Account Suspension and Termination
CameKart reserves the right to suspend or permanently terminate any account that:
- Violates these Terms & Conditions
- Provides false or misleading information
- Engages in fraudulent activity
- Receives multiple verified complaints from other users
- Attempts to manipulate the ratings, points, or contact system
Upon termination, your profile will be removed and your remaining points will be forfeited. CameKart is not obligated to provide advance notice in cases of serious violations.
15. Modifications to the Platform and Terms
CameKart reserves the right to:
- Modify, suspend, or discontinue any feature of the platform at any time
- Update these Terms & Conditions as needed
When Terms are updated, we will revise the “Last Updated” date at the top of this page. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, including the Information Technology Act, 2000 and applicable rules thereunder.
Any disputes arising from these Terms or your use of CameKart shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of competent courts in Madhya Pradesh, India.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CameKart regarding your use of the platform and supersede all prior agreements or understandings.
